3. Why do you choose this topic or research question: Analysis of the sources of law in China’s legal system is critical to understanding what source of law is responsible for establishing government’s framework, and spelling fundamental rights and duties of the Chinese people.
4. What is the significance of your research : it sheds light on the importance of law in formation of government and protection of fundamental rights of people even a communist society like that of China.
5. My major arguments and propositions: are that People’s Republic of China’s Constitution is the highest source of law and it establishes a socialist state. The constitution was adopted in 1982 as the supreme law of the country (Chiu, 1985). First, the 1982 constitution is the highest source of law because it places the power of the government into the hands of the people spelling out their desired framework of government, their fundamental rights and duties, and the general principles that are supposed to guide government and society. Second, the preamble of the constitution solidifies and stresses the leadership of Communist Party of China ruling out the possibility of the country opening up political space and competition (Chow, 2015). Third, the constitution’s preamble solidifies Marxism-Leninism and Mao Zedong Thought as the basic intellectual framework and ideology to guide the country. The constitution spells out the guiding principles of government and society. The desired state is a socialist state and this has been stressed in the constitution (Zhang, 2010). A socialist society is dependent on Marxism-Leninism theoretical framework for its full functionality. Also, by placing the power of government into the hands of China’s citizens of all nationalities is a confirmation of the supremacy of the constitution.
