Human rights violations in China
As the members of P5 in the United Nations and the only communist country in P5, China, my home country, still have lots of human rights violations in different areas in 2017. Under the leadership of the Chairman of Chinese communist party, President Xi Jinping, the fundamental human rights are still not guaranteed in modern China. In the policy paper, I will focus on the human rights violations of the freedom of expression.
According to the United Nations, human rights are very important, it “Ensures that a human being will be able to fully develop and use human qualities such as intelligence, talent, and conscience and satisfy his or her spiritual and other”. In my point of view, human rights are the basic and minimum necessary for people to live with dignity, for people to actually be a human.
In my policy paper, I will do research about Chinese human rights violations in the freedom of expression. I will research about these issues and to analysis about the improvement or the backward of situations of these human rights elements in China. Furth more, I will discuss the role of UN in each of the situations and points out the current policy of them. At the end, I will give my own recommended option for policies in each individual situation.
The freedom of expression in China is in a very awkward situation. In the Chinese constitution, Article 35 Citizens of the People’s Republic of China enjoy freedom of speech, of the press, of assembly, of association, of procession and of demonstration but the Chinese government has its unique media censorship policy that allows authorities to crack down on news stories that they expose state secrets and endanger the country this is also the reason that Facebook, Twitter and etc are blocked in China . Furthermore, the Communist government will limit the freedom of expression of the Chinese dissident, the most famous case will be Liu Xiaobo, the human rights activist and Nobel Peace Prize winner was incarcerated as a political prisoner in China. One of the fundamental problem with the Chinese human rights violations on freedom of speech is that the national legislature makes supplementary laws for the Chinses Communist party to violate Article 35 in the Chinese constitution.
With the power and the control of the Chinese Communist party, the solutions for the human rights violations will be a slow process that involves the UN participation. First is to allow the international social networking websites like Facebook and twitter in China. In 2011, the UN special Rapporteur Report point the freedom of internet, In Summer of 2016, the United Nations Human Rights Council released a non-binding resolution condemning intentional disruption of internet access by governments. The resolution reaffirmed that “the same rights people have offline must also be protected online”. The freedom of the internet will help Chinse people to gain access to the internet and help them to understand more about China from a different perspective. Second is to protect the UN staff, experts on treaty bodies, and independent experts focusing on specific human rights issues in China, as a member of the United Nations Human Rights Council, The Chinese communist party has the duty and the obligation to let UN staff to exam and help the human rights in China. When the right of these UN staff is protected, they can ensure the independent members of civil society from China have access to international human rights mechanisms. Third is to give China pressures to stop punish the Chinese dissident. To give the dissident dignity and respect to the Chinese dissident will be a great step for the right of expression. Finally is to connect the Chinese young generations with the “outside world”, because to finally solve the human rights violations in China will be a long process, the young Chinese generations will be very important in this process, they will eventually become the core levels of the country, to make them understand the important of freedom of expression will eventually solve the human rights violations in China.
